MySpace aangeklaagd voor aanranding minderjarigen

De families van vier meisje vervolgen MySpace.com en zijn eigenaar News Corp omdat de tieners seksueel aangerand zouden zijn door volwassen gebruikers van de site. De families dienden klacht in bij het Hooggerechtshof van Los Angeles en stelden dat MySpace en NewsCorp geen beveiligingsmaatregelen namen om te verhinderen dat volwassen kinderen op de site manipuleerden. Dit ondanks wijdverspreide waarschuwingen voor misbruik.

Blijkbaar bestaat de taak van de ouders dezerdagen enkel uit het "produceren" van kinderen. De opvoeding en opvang is de taak van kinderopvang, school, internet, media, enz...

MySpace Sued By Parents Who Don’t Keep an Eye on their Kids

This isn’t a surprise: News Corp is being sued by four families whose underage daughters were sexually abused by people they met on MySpace. The families, from New York, Texas, Pennsylvania and South Carolina, filed separate suits on Wednesday in the Los Angeles Superior Court. News Corp stands accused of fraud, negligence, recklessness and negligent misrepresentation - essentially, that MySpace does nothing to prevent these events from occurring. (No word yet on what the parents did to prevent it.) MySpace is currently developing tracking software for parents, but too late to prevent these cases.
The details aren’t pleasant. The plaintiffs are a 15-year-old Pennsylvania girl who was kidnapped and sexually assaulted in 2006; a 15-year-old Texas girl who was drugged and sexually assaulted (also in 2006) before being tracked down by the Houston police and the FBI; a 14-year-old New York girl who was given alcohol, drugs and assaulted by two men; and two South Carolina sisters, aged 14 and 15 who were also given alcohol, drugs and were assaulted. All the adult MySpace users involved have either been arrested, are on trial, or are currently serving jail sentences. The families want payouts in the “millions of dollars”.
News Corp has been sued before over this issue: in June 2006, a lawsuit was filed in a Texas state court over a 14-year-old who claims to have been sexually assaulted by a 19-year-old. That lawsuit is pending, and the damages being sought amount to $30 million.

The crimes are horrendous, and the perpetrators are getting what they deserve. But the question is whether MySpace is really negligent, since the Internet has always carried these dangers. These days it’s MySpace, but a few years ago it was chat rooms that posed a risk. Maybe MySpace’s site architecture increases the danger, but I’m also left wondering how all those events took place without the parents noticing - there’s got to be negligence on their part, too. If these predators had communicated with the kids via phone calls, the phone company wouldn’t be to blame.
And if MySpace did require credit card verification or offered parental tracking tools, it would scare off their entire user base. What MySpace will likely do is to continue releasing semi-useful tools, employ child safety advisors and put out press releases saying that they’re tackling the issue. The truth, though, is that there really is no definitive answer, aside from asking parents to monitor their kids’ activity on the web.
